Medical Examinations and Inquiries Employers may not ask job applicants about the existence, nature, or severity of a disability.
Undue hardship is defined as an action requiring significant difficulty or expense when considered in light of factors such as an employer's size, financial resources, and the nature and structure of its operation.
Citizenship Status It is not a violation of this policy to discriminate because of citizenship status which is otherwise required in order to comply money for nothing sex scene law, regulation, or executive order, or required by federal, state, or local government contract, or which the State Attorney General determines to be essential for an employer to do business with an agency or department of the federal, state, or local government.
Except as provided in paragraph C, a covered entity may not conduct a medical examination or make inquiries of a job applicant as to whether the applicant is an individual with a disability or as to the nature or severity of the disability.
